Governance of the usage of wireless access points falls under ACMA’s responsibility.

Hardware

Hardware needs to comply with ACMA regulations and as such must hold the C-Tick to be used within Australia.

WiFi is considered for local (short distances) use only. Spectrum sharing requires all users to transmit at very low power. The access points in use therefor can not exceed a certain power usage limit.

Carrier License

Non-commercial usage falls within the meaning of exempt network, and as such would not require a carrier license to operate.

Wireless LANs–exempt and non commercial networks fact sheet states:

“If a WLAN falls within the meaning of ‘exempt network’ under subsection 34 (3) of the Telecommunications Act 1997, the owner of the exempt network is not required to hold a carrier license.”

“In general, if a network owner derives no monetary payment or other form of tangible reward from the use of its network to supply carriage services, such use is likely to be non-commercial.”
